1. Acceptance and eligibility
These Terms of Service (“Terms”) govern your use of Stample, operated by Schouten Online OÜ (registration number 17338507, Sepapaja tn 6, 15551, Tallinn, Estonia). By creating an account or using Stample, you agree to these Terms.
To use Stample you must:
- Be at least 18 years old
- Provide accurate information at signup
- Have the legal capacity to enter into a binding agreement in your country of residence
If you are under 18, do not use Stample. We will delete accounts belonging to users under 18 without notice.
2. Account responsibilities
- Keep your login credentials secure. You are responsible for all activity on your account.
- Create only one account per person. No multiple accounts, no bots.
- Do not impersonate other people, celebrities, or Stample staff.
- Notify us immediately at team@stample.world if you believe your account has been compromised.
- Your username can be changed once after registration. After that it is locked. Choose carefully. Stample reserves the right to require a username change in cases of impersonation, offensive content, or trademark violation, regardless of prior change history.
3. Acceptable use
You agree not to:
- Harass, threaten, intimidate, or stalk other users
- Share or post content that is hateful, discriminatory, or promotes violence
- Dox other users: share their private information without consent
- Spoof your GPS location to fake check-ins or earn XP fraudulently
- Use bots, scripts, or automated tools to interact with Stample
- Scrape, copy, or systematically extract data from Stample
- Upload illegal content or content that infringes third-party rights
- Use Stample for commercial solicitation, spam, or pyramid schemes
Violations may result in content removal, account suspension, or permanent ban without refund.
4. Your content
You own the content you post to Stample: your photos, spot contributions, notes, and profile information. By posting content, you grant Schouten Online OÜ a non-exclusive, worldwide, royalty-free, sublicensable, and transferable licence to host, display, distribute, and promote that content within the Stample app and in marketing materials. This licence ends when you delete the content or your account, subject to the limitations described below.
You can delete your content at any time through the app.
5. Photo uploads
When you upload a photo, you confirm that:
- You took the photo yourself, or have all necessary rights to upload and licence it
- The photo does not contain nudity or sexually explicit material
- The photo does not show identifiable individuals without their consent
- The photo does not reproduce copyrighted material you do not own
- The photo does not contain illegal content
We may use your uploaded photos in Stample marketing materials (social media, App Store, website, ads), crediting you by your Stample username where the format allows.
Deleting a photo removes it from in-app display and prevents future marketing use, but does not retroactively remove photos already published in live marketing materials. We may remove any photo that violates these rules, with or without notice.
6. Copyright takedowns
If you believe content on Stample infringes your copyright, please contact us at team@stample.world with the subject line “Copyright Takedown” and include: your contact information, a description of the copyrighted work, the location of the infringing content within Stample, a statement that you have a good-faith belief the use is not authorised, and a statement that the information is accurate and that you are authorised to act on behalf of the copyright owner. We will acknowledge your notice within 5 business days and remove infringing content where appropriate.
7. Gameplay integrity
XP, badges, streaks, and levels have no monetary value and cannot be transferred, sold, or exchanged. They are virtual indicators of your activity within Stample.
We may adjust, reset, or revoke any gameplay element at any time, for example, to correct errors, respond to abuse, or rebalance the system. Such changes will be made only when necessary, but we reserve the right to make them.
Cheating, including GPS spoofing, automated check-ins, or exploiting bugs, will result in XP/badge revocation and may result in account suspension or permanent ban. Detected cheating behaviour is logged and may be used as evidence in enforcement decisions.
8. Stample Insider: premium subscriptions
Stample offers an optional premium subscription called Stample Insider, available in weekly, monthly, and yearly plans. The current price for each plan is shown in the app at the point of purchase, in your local currency.
Subscriptions are billed through Apple and governed by Apple's payment terms. Your subscription renews automatically at the end of each billing period unless you cancel. To cancel, go to your device Settings > Apple ID > Subscriptions.
Refunds are handled by Apple. We do not process subscription refunds directly. Contact Apple Support to request a refund.
EU consumers: if you purchase a subscription and have not yet used any premium features, you may have a 14-day right of withdrawal under EU consumer law. By accessing premium features before the 14-day period ends, you expressly consent to immediate performance and acknowledge that your withdrawal right is extinguished at that point.
9. Termination and suspension
You can delete your account at any time through Settings. Deletion permanently removes your data as described in our Privacy Policy. Any remaining subscription time is forfeited on deletion. No refunds.
We may suspend or terminate your account at any time for violations of these Terms, for activity that harms other users or Stample, for extended inactivity, or where required by law. For serious violations (harassment, fraud, illegal content) we may act immediately without prior warning.
10. Disclaimers
Stample is provided “as is” and “as available”. We make no warranties that the service will be uninterrupted, error-free, or that spot information will be accurate, complete, or up to date.
Spot listings may be incorrect, outdated, or inaccurate. Always verify independently before visiting a location. Do not rely on Stample for navigation, safety decisions, or to confirm legal access to a location. Physical safety while travelling is your responsibility.
We are not responsible for the actions of other users, the content they post, or anything that happens as a result of interactions initiated through Stample.
11. Limitation of liability
To the fullest extent permitted by applicable law, Schouten Online OÜ is not liable for any indirect, incidental, consequential, or punitive damages arising from your use of Stample.
If we are found liable to you for any reason, our total liability is limited to the greater of: (a) the total fees you paid to Stample in the 12 months before the claim arose, or (b) EUR 100.
These limits do not exclude or limit liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded under applicable EU consumer law. If you are a consumer in an EU member state, your statutory consumer rights are not affected by these Terms.
12. Indemnification
You agree to defend, indemnify, and hold Schouten Online OÜ harmless from any claims, damages, losses, and expenses, including reasonable legal fees, arising from your use of Stample, your content, or your violation of these Terms or any applicable law.
13. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will notify you via in-app notification or email at least 14 days before the changes take effect. Continued use of Stample after the effective date constitutes your acceptance of the revised Terms.
14. Governing law and jurisdiction
These Terms are governed by the laws of the Republic of Estonia, without regard to conflict of law rules. Any disputes arising from these Terms or your use of Stample shall be resolved in the courts of Estonia.
However, if you are a consumer resident in an EU member state, you may also bring claims before the courts of your country of residence, and your mandatory local consumer rights are not affected by this clause.
EU online dispute resolution: if you are an EU consumer, you may also use the European Commission's online dispute resolution platform at ec.europa.eu/consumers/odr.
